The 5th's requirement concerning takings leaves no wiggle room, whether a legislation has been passed or not. Even the taking for failure to pay property tax requires that the government that took the property pay proper value excess over the tax bill to the owner from who the property was taken. Unless We the People wrote an exception into our Constitution, no exception exists. That goes specifically for what we call the Bill of Rights. If the words are not there in black and white, the words cannot be added by some subordinate entity claiming authority that is not also written in the document.
